So, I have a scary Legal Eagle for you today. A lawsuit was filed against McDonald's and its insurance carrier, Traveler's Insurance, for breach of contract, negligence, consumer protection violations, and a few other things because McDonald's stole a chicken McNugget from one of its customers.
Let me set the stage: Father and son, after a long day, when tot McDonald's to have a father-son evening outing. The six-year-old boy ordered his favorite, a Happy Meal with chicken McNuggets. Unfortunately, the meal did not make him very happy. When he went to eat his last McNugget, he refused to do so because it looked "reddish." The local Micky-D's offered a new, "fresh" nugget, but the parents refused. Instead, they kept the McNugget as a momento and went home. The next day, the boy was ill, and the parent's freaked out. As the boy's stomach ailments became worse, the parents decided to freeze the chicken McNugget.
Enter Traveler's Insurance. The insurance provider for McDonald's offered to take the chicken McNugget and have it "tested" for the boy's family. The family, all of whom must have been affected by the power of the McNugget, agreed (bad, bad, bad, bad idea). Traveler's took the nugget, tested it, let McDonald's know the result, and then refused to share any results with the public. They did, however, return the 20 percent of the chicken McNugget that remained after testing to the family, though it had become "ashy and charcoal-like" in appearance. It is unclear whether the family has put the remaining nugget back in the freezer, but the family is suing to know the results of the testing.
Okay, I would like to give a little NON-LAWYERLY advice here in case this ever happens to you: (1) Do not eat at McDonald's, eat at Chic-fil-A (if this family had gone to Chic-fil-A, there would have never been a problem with a "reddish" nugget); (2) NEVER, EVER, EVER trust the other guy's insurance provider (this seems so obvious to me that I refuse to provide any more of an explanation); (3) I do have doubts about the family's victory based on the argument that the boy became sick, doesn't everyone get sick after eating chicken McNuggets at McDonald's?; and (4) If you ever find yourself in this situation, get a lawyer first, then talk to the other guy's insurance company, if you don't, you may never see your beloved, reddish McNugget again.
